1. Agreement
By ordering, accessing or using StreamData Networks services, you agree to these Terms of Service, the Acceptable Use Policy, Backup Policy, Privacy Policy and any service order or invoice terms issued for your account.
2. Eligibility and authority
You must be legally capable of entering into this agreement. If you order service for a company, organization or client, you confirm that you are authorized to accept these terms for that party.
3. Services
StreamData Networks provides virtual private servers, dedicated servers, protected network services, IP resources, storage, support and related infrastructure services. Specific plan limits, billing cycles, locations, support scope and add-ons are shown at order time or in written quotation.
4. Customer responsibility
You are responsible for account credentials, server configuration, hosted content, users, applications, scripts, licenses, backups, legal compliance and traffic generated from your services.
5. Prohibited use
You may not use services for unlawful, abusive or harmful activity. Prohibited activity includes malware, phishing, spam, unauthorized scanning, credential theft, copyright infringement, DDoS origination, botnets and activity that harms StreamData Networks, upstream providers or third parties.
6. Billing and payment
Services are billed according to invoice or order terms. Payment must be made by due date. Taxes, TDS, payment gateway fees, software licenses, IP charges, setup fees and overage charges may apply where relevant.
7. Suspension and termination
StreamData Networks may suspend, restrict or terminate services for non-payment, abuse, security risk, legal requirement, upstream complaint, inaccurate account information or violation of these terms. Where practical, notice may be provided; urgent abuse or legal issues may require immediate action.
8. Cancellation and refunds
Cancellation requests must be submitted through official support or billing channels. Unless expressly stated in writing, setup fees, monthly fees, licenses, IP charges and consumed services are non-refundable. Customers should provide 30 days advance notice for planned cancellation of recurring services.
9. Data, logs and government requests
Customers are responsible for data and activity hosted under their services. If lawful authority requests customer data, logs or account information, the customer may be required to provide required information or cooperate with the request according to applicable law.
10. Service changes
Plans, locations, hardware, pricing, upstream routes and features may change due to availability, supplier changes, legal requirements or operational need. Active customers will be handled according to applicable order terms where possible.
11. Intellectual property
StreamData Networks website content, branding, design, software, documentation and service materials remain property of StreamData Networks or its licensors. Customers retain ownership of their own lawful hosted content.
12. Limitation of liability
To maximum extent permitted by law, StreamData Networks is not liable for indirect, incidental, consequential, punitive, special or lost-profit damages arising from service use, suspension, interruption, data loss or third-party claims.
13. Indemnity
You agree to defend and hold harmless StreamData Networks, its employees, contractors, affiliates and suppliers against claims, losses, liabilities, penalties and costs arising from your hosted content, service use, violation of law or violation of these terms.
14. Governing law and jurisdiction
These terms are governed by laws of India. Unless otherwise required by law or written agreement, disputes are subject to courts having jurisdiction at Jaipur, Rajasthan, India.
15. Updates
StreamData Networks may update these terms. Continued use after publication or notice of updated terms means acceptance of the revised terms.
